You cannot try someone in a state court for a federal crime.

Many offenses are only punishable in federal court, and vice versa. But Bugliosi does seem to lay out a case in his book on how state courts can have jurisdiction.

Wrong! The Rodney King beaters were found not guilty in State court but were found guilty in federal court because both it was both a state and federal crime. You can't be tried twice in the same jurisidction, otherwise this would be double jeapordy.

Because state law is seperate from federal law, the President cannot be pardoned. A pardon is an executive order to a US attorney, federal agent, etc not to arrest, indict, or seize assets of an individual under federal jurisdiction. IF SOMEONE IS FOUND GUILTY IN BOTH FEDERAL AND STATE COURTS, A PRESIDENT PARDON WOULD ONLY GET THEM OUT OF THE FEDERAL CONVICTION.

Ms. Condi Rice is a class act. But I do have a problem with her pandering to Barack Obama. I think deep down she is a liberal.
 
I don't like Condi Rice, because she supports Obama in his bid to become our next President. But she is certainly not guilty of war crimes.

She hasn't been charged yet. So she can't be found guilty of war crimes, yet.

Personally she seems like an ok person but she was the President's Nat. Sec. Adviser and US Sec. of State during last 7 years, a period that has seen one of the most incompetent US foreign policies and reckless adventures like Iraq. What is so classy about being incompetent and ignorant .. or worse - lacking integrity and courage to stand up against horrific blunders and instead participating in the screw ups?

Police corruption can be prosecuted as a federal crime. If they had been ordinary citizens, it wouldn't have been possible.

Also, if both federal and state courts can claim jurisdiction over a crime, they can both get convictions. This is an exception to the double jeopardy clause (dual sovereignty). They did it to McVeigh.

Although "dual sovereignty" is really a variation of the same offense issue, it is usually treated separately. Suppose the federal Congress and a state legislature have identical criminal statutes. Can a defendant be charged and convicted (or acquitted) of an offense in federal court and then tried in state court? What if the defendant is first tried in state court? This issue is called "dual sovereignty" because the original thirteen states were separate political entities until they joined the federal union and gave up some of their sovereignty to the federal government. The states did not give up their right to define and punish crimes.

Agreed... this is what I was saying - that the state can prosecute a crime that the federal government did or did not. However, they must prove jurisdiction. Have identical criminal statutes doesn't give them jurisdiction.

For instance, all states have statutes against robbery, as does the federal govt. However, a federal govt cannot try a robbery case unless it involves federal or federally insured property (ie bank money), was committed on federal land, etc.

Similarly, a state must prove jurisdiction over the crime - not just that the crime was committed. Of course, this is what Bugliosi set out to do and has achieved.

If he has the evidence to take Bush to trial, I would like to speak with him about doing just that. If Congress refuses to impeach George Bush, I find it absolutely necessarily that, We The People, take George Bush to court.

Yep. We need to convene a 7th Amendment Common Law Grand Jury.

Vincent Bugliosi was on Alex Jones and said he doesn't use a computer, so I guess you would have to call or write.

Its taking a while for the next impeachment hearings to happen. I guess it'll be stretched out until Bush is out of office.
