The Bush Administration's original plan (or the Paulson Plan) was so out there with that clause about the Secretary of Treasury's discretions and making his actions non-reviewable by Congress or any court of law, they KNEW that that wouldn't fly. They purposely introduced the plan that way so they would have enough to "give up" and compromise, and it would look like this is a bipartisan agreement.
 
Some people call this anchoring. When you are fishing in a river you anchor up stream of the fishing hole. Toss the anchor out 100' above your chosen spot, then drift into place. But in Bush's world, I think he would have preferred to be as far up the river as possible. And then leave us without a paddle!
