Hillary Clinton Gives Interview to FBI About Emails, Campaign Says

I wonder what the quid pro quo will be. "When I become President and you do not recommend any charges, I will..."

Now there is nothing stopping the FBI from proceeding to a press conference to announce if they are going to give a criminal referral of Hillary to the DOJ. If the answer is yes, it would be a kindness to Democrats for Comey to announce it before their convention, in order to give the delegates a more informed choice about whether to nominate her.

Announcing the news after the convention would be seen as more cynical and political, as it puts Democrats in the wounded position of running an already nominated candidate whom the FBI has recommended for indictment.
 
Look, even IF the FBI feel there is enough evidence to bring charges or to indict, it still will never ever EVER happen. There is no one in the entire Obama administration that will bring charges against her, period. As a result, she will skate into the Presidency and if so desires, drops the entire investigation herself.

As I said, nothing to see here. Nothing will come of this.
 
I'm guessing she made a proffer agreement in exchange for the interview.

A "Proffer" or "Proffer Letter," commonly referred to as a "Queen for a Day," is an agreement to conduct an interview between a federal prosecutor (Assistant United States Attorney, or "AUSA") and a prospective defendant (person under criminal investigation) regarding information he or she may have pertaining to some criminal activity. The purpose of this interview for the potential defendant is to obtain some type of leniency or immunity from the Government in exchange for that information. The prosecutor's purpose is to obtain an honest and credible preview of what the potential defendant knows about certain crimes and how he or she would testify at trial. In exchange for a look at this potential testimony, the AUSA promises not to use the Proffer statements or information against the potential defendant in the government's case-in-chief. The person interviewed can be a witness, person of interest, or a target of the investigation. The meeting takes place in the offices of the federal prosecutor and is usually conducted in the presence of the defendant's attorney, the AUSA, and federal agents.

"Queen for a Day" would definitely appeal to Hillary.

Ah, but the optics of the FBI formally advising "we recommend Clinton be charged with X felony counts of negligent mishandling of classified data, criminal intent to misuse classified data, violating the Espionage Act, obstruction of justice, lying to prosecutors, lying to Congress, etc" would be devastating, regardless of what DOJ does with the referral.

That prospect is probably what led to the desperation meeting on the plane this week. There may also be a growing realization on the part of Clinton that, once the referral is publicly on record, if the Democrats lose, President Trump might actually follow through with the indictment upon taking over DOJ in January.

CNN has previously reported no charges were expected to be brought against Clinton because the investigators had not found evidence to warrant charges, according to multiple law enforcement officials. A Democrat close to Clinton said Saturday the campaign believes the FBI will announce its decision before the conventions.

Sources familiar with the investigation had previously told CNN the Justice Department's aim was to wrap up before the Republican and Democratic conventions later this month. The timing is crucial, because if Clinton were to be indicted before the convention, Democrats could perhaps nominate another candidate.

not that it really matters, but is 'interview' the word they would have used if it was practically anyone else? Seems like 'for questioning' or 'interrogation' is more normal.

The people who are capable of voting for Hillary now, will still be capable of voting for her even if she was a felon. It wouldn't matter to her base if Hillary Clinton sold national secrets to the Chinese.

I'm still confused why it's not an open and shut case. Her defenders say it wasn't illegal at the time, but now it is --that negligence is not punishable under USC 18.
