It's true that the FBI stats are based on crime reports submitted to the FBI voluntarily. The question would be why didn't CT submit (and presumably still has not) the Newtown homicide numbers, while submitting the rest of the crime figures? Doesn't really matter though since the lawsuits are still nowhere to be found and there's no way 27 people died inside a public school during business hours and no lawsuits were filed by any of the families for negligence. Just doesn't happen with the litigious nature of this country and ambulance chasing attorneys licking their chops at such a high profile 'event'.

Btw, same with Boston afaik. No lawsuits.

Also it is worth noting that the Statute of Limitations for wrongful death in Connecticut is 2 years. That means the families would still have a couple months within which to file a lawsuit.

After the tragic 2012 shooting in Newtown, lawyer Irving Pinsky sued the Connecticut Department of Education on behalf a first-grader at Sandy Hook Elementary School who suffered emotional trauma. The Internet and mass media responded to Mr. Pinsky's claim with outrage — calling it "completely inappropriate" and "wrong on every level" — causing Mr. Pinsky to withdraw the case.

In many ways, this antipathy makes sense. Mr. Pinsky's case was filed a mere few days after the shooting, and pointing fingers at the recovering school district seemed akin to rubbing salt into an open wound. With the recent one-year anniversary of Sandy Hook, however, it is appropriate to reflect on whether the public shaming of Mr. Pinsky's client dissuaded other litigants from stepping forward — and whether lawsuits, while not always the answer, may help some grieving families.

Lawsuits commonly occur in the wake of school shootings. After the Columbine massacre, parents of killed and injured students brought 17 lawsuits, against the Colorado school district, law enforcement officials and the parents of the two shooters. Likewise, after the deadly Virginia Tech shooting, families of many deceased students brought claims against the Virginia Tech administration.

The Columbine and Virginia Tech plaintiffs did not face the same intense online shaming that Mr. Pinsky and his client encountered. Although lawsuits are not always the answer to a school tragedy, and may sometimes have damaging consequences for a grieving community, the public should not harshly criticize families who seek legal redress. In the Columbine and Virginia Tech cases, the lawsuits unearthed facts that can help prevent future tragedies, giving plaintiffs a sense of purpose and meaning, and they provided answers and closure for grieving families.

The Columbine lawsuits revealed knowledge that the school and law enforcement officials possessed, which, if acted upon, may have prevented the tragedies. In these cases, plaintiffs alleged that, before their murderous rampage, the shooters, Eric Harris and Dylan Klebold, who previously were apprehended by the local sheriff's department for breaking into a van, had violated the terms of a juvenile diversion program by making violent statements on a website. These included threats to make explosives and kill people, and even specified the day on which the boys planned an attack.

Several school officials and teachers were also allegedly aware of Harris and Klebold's suspicious behavior and vicious statements. Although the courts dismissed the vast majority of the Columbine cases, the lawsuits highlighted the warning signs leading up to the tragedy. Even if the school officials or law enforcement agents were not held liable, perhaps they, and others, can learn from these warning signs and prevent a future tragedy.

The Virginia Tech lawsuit exemplifies a case that provided some closure and redress for two grieving families — the parents of deceased students Erin Peterson and Julia Pryde. In the Virginia Tech tragedy, a student, Seung-Hui Cho, murdered two of his classmates in one of the Virginia Tech dormitories. Roughly 21/2 hours later, Cho broke into one of the university's classroom buildings and gunned down an additional 30 students and professors before killing himself. Families of the deceased students brought suit, alleging that school officials knew many facts about the first killing and there was sufficient time before the mass killing for the officials to warn the university community of the danger.

This may be true for run-of-the-mill liability disputes but not for such high publicity events where lawyers stand to make huge amounts of money as parts of settlements after suits are filed. Just doesn't ring legit, considering the avalanche of suits after other school shootings. This is outside of all of the other inconsistencies and oddities with the SH event.

How exactly was it that James Holmes, while equipped in full battle gear with a ballistic helmet, gas mask, and being armed with a $1,200 M&P15, $600 Remington 870ET Shotgun, and $550 Glock22, manage to launch off two gas grenades and not get tackled down prior to even opening fire, meanwhile keeping his composure and not getting all those guns, magazines, ammo reloads, and finding those pins to pull out in the dark and with a limited field of vision and (a likely) fogged up gas mask?

Why was James Holmes wearing full-body ballistic resistant gear, but with exception to his vest (which was merely a tactical vest), including bullet proof protection for his head, throat, crotch, and legs—but nothing whatsoever for the most likely target, his ‘ten-ring’ area.

Aurora (i.e., Greek goddess Eos), is synonymous to dawn, which the incident took place just before 1am.

Newtown, is synonymous to new-town, which the incident took place in the middle of morning.

(I.e., The dawn of a new day. What exactly are the odds? On par with the events surrounding 9/11?)

The Sandy Hook Middle School in Newtown was immediately, and pointlessly, razed in order to build a ‘new’ school (racking up $49.3-million in demolition fees, demolition workers were required to undergo a confidentiality clause, and now the district is down one school capable of housing nearly 1,000 students).

Any thinking person knows that the question regarding an FBI procedure is not addressed to Connecticut State Police (CSP). The FBI does not report to the Connecticut State Police. Who runs the FBI and tells them what to do? We can all speculate; however, none could fairly claim that the answer is "police officers in Connecticut".

Back on point, this question is basically a "who and why" of the same question and are answered together, thus:

The answer is Book 2 Document 182743.

CSP did a FOIA request to get the FBI report for themselves. The FBI, through Special Agent Kimberly Mertz, responded to the request on July 23, 2013. A notification from the FBI dated July 18, 2013 advised CSP that the FBI was releasing 109 pages of 173 pages of their report pursuant to FOIPA Title 5, US Code 552/552a.

The FBI included a notification that there are three discrete categories of law enforcement and national security records that are excluded from FOIA as in USC 5 552(c) .

All 109 pages of the FBI report that the State Police received are INCLUDED in the report, downloaded as the above listed document. In other words, the FBI report is in fact, not entirely classified, and has already been released and may be freely downloaded and reviewed. Yes, it is heavily redacted; however, that is the FBI, not CSP.

64 pages are classified. How much does the FBI do in 64 pages? I would think... very little.

Moreover, that has nothing to do with Connecticut or the CSP, who were equally denied access to those 64 pages. Who in or above the FBI decided to classify the 64 pages? Who knows! But the question is not for Connecticut.

The fact is, the FBI had little to do with the investigation of Sandy Hook. This was a state run operation.

3. Who on Dec 14, 2012 was the Incident Commander as required by the Federal Emergency Management Administration in directing the Mass Casualty Shooting Incident at the Sandy Hook Elementary School?
Major Brian Meraviglia, the Western District Commander, was the commander of the crime scene, once a command center was formally established.

Four wounded people were transported by ambulance. The premise of the question is incorrect because the report is clear, the rest were dead.
Halbig needs to clarify his question because there were no others "clinging to life". Who is he talking about here?


5. Who and Why did they not allow the Paramedics and the EMT’S inside the Sandy Hook School to treat the seriously injured or those children and school staff clinging to life?

Again, Halbig's premise is incorrect, because it is not true that Paramedics and EMT's were not allowed in the school.

3 of the most seriously wounded were treated by 2 paramedics and 4 EMTs, within the "first response" time frame.

The premise is incorrect because no one declared all those people dead in the first 8 minutes.

While technically, that answer would suffice to answer Halbig's poorly worded question, for the sake of clarity, I will pretend he asked a relevant question concerning the legal/procedural aspects of the triage of the casualties.
The legal presumptions of death were made by Cassevechia, Reed, and Meehan, using the SMART Triage System protocols; performing four different assessments on each patient prioritizing them based on their apparent injuries.
Cassevechia maintained phone contact and operated as the senior medical person on scene. The paramedics triaged the casualties operating on the legal authority granted by Dr. Pat Broderick, Danbury Hospital.

Again, Halbig's premise is incorrect. He was not "off -duty". Book 4 79290.

He was doing an "extra duty" assignment. The public record of this shows he received a written reprimand for failing to respond (Google). I would ask, how is this relevant? He was derelict, no matter what the answer is. Some people in any place of employment are derelict. He is one.

Who at the Newtown Public Schools notified all of the parents in writing as required by CT law that had children attending the Sandy Hook Elementary School as well as every school staff member every school year of all the potential life threatening chemical hazards. Page 28 has the required notice. The school appears compliant with the law in terms of safety, reports, and notifications. CT dot Gov website also has their specific requirements. My feeling is Halbig did not research this issue on his own.

Inside the school, triaging the victims were:

  • two EMTs: Sgt William Cario amd TFC Patrick Dragon
  • one Registered Nurse: William Blumenthal
  • three Paramedics: Director of Danbury EMS Paramedic Matthew Cassevechia, and two Tactical Paramedics, John Reed and Bernie Meehan.

This is a disgusting, irrelevant question to ask the parents of deceased children. Further, the answer is beyond the scope of any rational police investigation. What kind of question is this?

How do you know they were asked to donate organs? How do you know they didn't? How do you know if murder victims can donate organs before autopsy or how that plays into it? I won't waste my time on this question because it is completely lacking a rational foundation.

While one can imagine an almost unlimited response to this question, to keep it focused on the immediate scene, the survivors were evacuated. The evacuation is documented in dozens of sworn statements in Books 4 and 6. Please read the report and ask a specific question that can be answered with specifics.

Again, your premise is incorrect; you misstate the officers words here and in every embellished interview you give.

However, the report timeline documents that this officer's name was Officer Leonard Penna.

See Venghele, Bahamonde, and Penna's statements. At the time of this incident, none of the officers had been in Room 8, they were unaware there are deceased in Room 8, and were training weapons in the direction of the girl and operating in Active Shooter formation and under those protocols.

The account of the FIRST GRADE Boy and Girl hiding in the restroom are documented by their rescuer, TFC Smith in Book 6 47345
He is documented as running out with the survivors in Davis' Dash Cam at 0957:18. This is listed in the timeline Book 4 184096 and the time line of Davis' Dash Cam Book 3 55705.
There was no delay in their rescue and they did not wait until the scene was "safe" to rescue them.

(CNN) -- Outcry over a request for permission to sue the state of Connecticut for millions of dollars in the aftermath of the Newtown shooting prompted a New Haven attorney to at least temporarily withdraw his client's petition, the attorney said Tuesday.

"I was getting hundreds of (Facebook) comments" about the potential lawsuit. "So I figured I'd take (the request) off the table for now," said Irving Pinsky, who represents the parents of a 6-year-old survivor of the mass shooting at Sandy Hook elementary school.

Last week, Pinsky said in his filing that the state had failed to protect his client from what he described as "foreseeable harm."
Since then, a flurry of online comments -- many of which surfaced on Pinsky's Facebook page -- blasted the potential lawsuit and accused Pinsky and his client of trying to profit from last month's tragedy.

"If it is not about money, please put out a public statement outlining all the steps that have been taken and avenues exhausted PRIOR to the lawsuit path," wrote John A. Yasnowski, a Facebook user. "Please share your advocacy plan. Please share the intended use of the money (if any).

The girl, identified only as Jill Doe, was at the school and apparently heard everything from gunfire to screaming over the intercom, Pinsky wrote in his Thursday letter to the state claims commissioner.

He said that the State Board of Education, Connecticut Department of Education and State Commissioner of Education were negligent in protecting his client by not providing a safe setting, failing to determine whether the local Newtown Board of Education had provided a safe setting, and failing to require the school and the local board to make an emergency response plan.

His client had been seeking $100 million in damages.

Lawsuits are always forthcoming after situations like that. The shooter's father is alive--the estate of his mother can be sued. The school district (as has happened with Columbine). Virginia Tech, Aurora Co. and even the Gabby Gifford's shooting had lawsuits.

They could start by suing for information that various levels of government are refusing to release, such as possible procedural violations, recklessness or negligence on the part of first responders, conflicting accounts of what took place that day, why ambulances were supposedly left to standby, what ever happened to the supposed shooters in trees, the armed man that was arrested and released as a concerned passerby, conflicting accounts of weapons used, why and how it was justified to make state taxpayers spend $50-million to raze a perfectly good school (and later hundreds of millions more to build its replacement), etc. And then from there they can work together, intelligently, to make a well informed decision and seek justified resolutions, as opposed to just being left in utter darkness by selfish liars and deceivers.

And better still they can seek redress to make unconstitutional "Gun Free Zones", because if just one staff member there was armed, this entire tragedy, if so actually true (although highly unlikey), could have been ended just as quickly is it had began.
