This took longer than I expected, but here it goes. The BC is the stooge of Holder. Are they suing Brownback or suing the state of KS? How is suing Brownback going to nullify state law?

The Brady Center to Prevent Gun Violence issued notice Monday of its intention to file a lawsuit against Gov. Sam Brownback to challenge a sweeping state law nullifying enforcement of federal firearms restrictions in Kansas.

Brownback said in response that attorneys for the state would vigorously defend the gun rights of Kansans.

Attorneys working for the Brady Center plan to challenge the constitutionality of Kansas' law, known as the Second Amendment Protection Act, in U.S. District Court. Details of a legal argument that the state law undermines federal gun laws in Kansas are to be revealed Wednesday during news conferences.

In April 2013, U.S. Attorney General Eric Holder sent a letter to Brownback asserting the Kansas law was unconstitutional. He cited the supremacy clause of the U.S. Constitution to contest the state's position that federal employees could be blocked from carrying out their responsibilities.

A provision of Senate Bill 102 exempts firearms manufactured and owned in Kansas from being subjected to federal law, regulation or authority. The bill's supporters did soften the measure by dropping language calling for arrest or detention of federal agents who sought to enforce federal gun control in Kansas.

"In purporting to override federal law and to criminalize the official acts of federal officers, (the law) directly conflicts with federal law and is therefore unconstitutional," Holder said.

Brownback said the reform bill he signed earned bipartisan support and wasn't worthy of intervention in a federal court. Kansans have repeatedly affirmed a commitment to protection of their fundamental right to bear arms and to preserve sovereignty of the state of Kansas, the governor said.

"It is a right enshrined not only in the Second Amendment to the United States Constitution, but also protected by the Kansas Bill of Rights," Brownback said. "The Obama administration attacked this legislation when I signed it more than one year ago. It now appears that they have found some Washington, D.C., lawyers to do their bidding."

Kansas Attorney General Derek Schmidt anticipated a legal challenge to the law and requested the Legislature budget $225,000 over a two-year period to cover costs of a legal contest.

In 2014, Brownback followed last year's law targeting federal enforcement by signing a bill that eliminated a patchwork of city and county restrictions on firearms. The latest measure implemented July 1 made it legal statewide to openly carry firearms and established new standards for lawful carrying of concealed weapons.

In a Monday news advisory, attorneys for the plaintiffs in Brady Campaign v. Brownback contend the 2013 state law to be unconstitutional. They argued the law allowed gun manufacturers in the state to make guns without serial numbers and to build guns designed to avoid metal detectors.

In addition, the law prohibited background checks for guns made in Kansas and the tracking of guns used in crimes. The law prevented local authorities from referring gun crimes to federal agencies.

The state law enabled otherwise prohibited individuals to obtain guns and crippled law enforcement’s ability to investigate gun crimes. It opened the door to sale of firearms to violent domestic abusers and sale of handguns to minors under the age of 21, the Brady Center said.

The Brady Center is a nonprofit organization that develops and implements public safety programs and utilizes the courts to reduce gun violence. The center's Legal Action Project represents victims of gun violence in cases against irresponsible gun sellers and owners.

God bless sovereign states. While I do believe the fight on the federal level is noble and worthy, the local level is where the greatest advancements for individual rights will be made. It is examples like this that give me hope for the spirit of freedom that exist within mans soul. We are not all servants to over sized collectivist governments and its about time more states, communities, men and woman start making stands for the beliefs they hold to be true.

The irony is overwhelming on several fronts. A group supporting federal restrictions is challenging the constitutionality of Kansas' law?! The challenge is against a law protecting the 2nd Amendment, yet, the group is challenging the constitutionality. In essence, they are challenging the constitutionality of an amendment of the Bill of Rights, not to mention challenging the constitutionality of states' rights.

Yes, GCA and NFA null and void for any firearm or accessory stamped MADE IN KANSAS, with the exception of full auto (the legislature wimped out on that one). Although the full auto may still be exempt from federal regulation, just maybe illegal to manufacture; need to look at the wording of the law. Suppressors, short barreled rifle and shotguns, etc made in KS are now free from tax stamps and other BS.

It has been that way since 7/1/13. No one yet has flaunted their MADE IN KANSAS suppressor on Youtube to the ATF, but you'd be perfectly legal to do so and get the ball rolling. We had been advised to wait for the federal lawsuit rather than risk personal arrest by ATF. The law was written by some very sharp people with a federal challenge in mind, so we'll see where it goes.

The anti-gun groups will be attacking KS since it probably has the most liberal (lack of) gun laws in the US. As of 7/1/14 open carry is now legal state wide with no local preemption. Since last year, no-CCW signs are null and void, and you can CCW in schools, bars, etc.. Public buildings can't prohibit (i.e. a trespass charge) if they don't have adequate security (metal detectors). Automatic knives, daggers, and sword canes now legal to carry. Great progress in the last 6 years; something has been accomplished every year. Hopefully constitutional carry is next.

Announces Intention to Sue Kansas

The Brady Center to Prevent Gun Violence announced on Monday, July 7, 2014 that they intend to sue the State of Kansas regarding the Kansas Second Amendment Protection Act which was passed and signed by Governor Sam Brownback in April 2013. Brady Attorney's said they intend to challenge the "constitutionality" of the Kansas law. They also announced they are holding a media conference on Wednesday, July 9th to make a formal announcement. Our sources tell us that this media conference will be done by telephone. Apparently they don't have the nerve to hold a public media conference in person as one would expect. Perhaps they are afraid that Kansas gun owners might show up in protest and ask them to go back to where they came from?

Since the overwhelming majority of Kansans are pro-Second Amendment I might respectfully suggest that they will be a fish out of water in this state and find their presence not at all welcome as it may be in other states where gun-control is rampant.

We have been told they have hired a law firm in Kansas City, MO to handle their case. The real question at this point is 'do they have standing'? We have talked with a few attorney's who advise they would need an injured party to have standing so the issue of standing is in question. We will keep you informed as this case progresses.

I have spoken at length with the Governors Office and have been assured that Attorney General Derek Schmidt and the State of Kansas will defend against this lawsuit vigorously. In addition, here is the Governor's response to the news of this lawsuit:

TOPEKA, KS -- Today, Governor Sam Brownback issued the following statement in response to a media release announcing the Brady Center to Prevent Gun Violence will file a lawsuit challenging the Kansas "Second Amendment Protection Act" which the Governor signed into law in April 2013.

"As I have said previously, the right to keep and bear arms is a right that Kansans hold dear. It is a right enshrined not only in the Second Amendment to the United States Constitution, but also protected by the Kansas Bill of Rights. The people of Kansas have repeatedly and overwhelmingly reaffirmed their commitment to protecting this fundamental right. The people of Kansas are likewise committed to defending the sovereignty of the State of Kansas as guaranteed in the Ninth and Tenth Amendments to the United States Constitution.

"The Obama administration attacked this legislation when I signed it more than one year ago. It now appears that they have found some Washington DC lawyers to do their bidding. We will vigorously defend the rights of Kansans in this litigation."
