I agree when speaking of liberty and rights, people should try and avoid constitutional positivism. Saying stuff like "I may bear arms because of the constitution" is unconvincing compared to the mass of arguments you could otherwise make.

Enforcement is the responsibility of we the people....ya think the government itself is gonna abide by limits if the people don't insist on it?
Who watches the watchers? Appearantly not the people anymore - take a look at the bailout. Nobody fucking cares, and nobody in the right places is doing anything about it.....we're fucked, you see.

Well, let's see, we have the government appointed Supreme Court to make the decisions as to whether the government is violating the Constitution. Does this sound like the fox guarding the hen house? It isn't like the Supreme Court is going to listen to The People when it comes to making these decisions. Is there anything The People can do to make the Supreme Court listen to them?
I dunno, I have heard plenty of folks say the Patriot Act is okay because the Constitution will prevent the government from abusing the power...I don't think anyone believes that a document can enforce itself.

What we need are people who can bear the burden of this "ring" and have the strength to take it back to the source and destroy it. That is, destroy the power it bestows.
