What the hell is a "constitution worshiper"? Your description makes no sense. I don't think anyone believes that a document can enforce itself. Geezus.

I agree when speaking of liberty and rights, people should try and avoid constitutional positivism. Saying stuff like "I may bear arms because of the constitution" is unconvincing compared to the mass of arguments you could otherwise make.

Why was this thread rated terrible? Its a good article.

This is a good article, thanks for sharing. I agree with it.

Is Truth warrior still MIA? I'm sure he would love this article.

Enforcement is the responsibility of we the people....ya think the government itself is gonna abide by limits if the people don't insist on it?

Who watches the watchers? Appearantly not the people anymore - take a look at the bailout. Nobody fucking cares, and nobody in the right places is doing anything about it.....we're fucked, you see.

so in short, might makes right.

Well, let's see, we have the government appointed Supreme Court to make the decisions as to whether the government is violating the Constitution. Does this sound like the fox guarding the hen house? It isn't like the Supreme Court is going to listen to The People when it comes to making these decisions. Is there anything The People can do to make the Supreme Court listen to them?

a typical response would be : "but the alternative is mob rule"

nodope, I like your signature.

Who will guard the guards themselves?

Good article, even if a bit constrictive.

I dunno, I have heard plenty of folks say the Patriot Act is okay because the Constitution will prevent the government from abusing the power...

Right, and the original method of doing this was the right to petition for redress of grievances, which very few people understand now. This was a cornerstone right of the people to withhold their taxes from government if they had a grievance. For more info:

Here’s a link with a short article just describing the basics:

Here’s a PDF link to the full book:

“If money is wanted by Rulers who have in any manner oppressed the People, they may retain it until their grievances are redressed, and thus peaceably procure relief, without trusting to despised petitions or disturbing the public tranquility.”

1774, Journals of the Continental Congress, 1:105-113

Right - it's an obvious conflict of interest.

See my post above.

The Constitution is a failed document and people who fail to realize that are like drunks and addicts who fail to admit they have a problem.

So they go into "grandpappy died for it" mode and might always makes right for these people.

The CON has those "public necessity" clauses in them, which amounts to Tolkiens "One Ring". People get so corrupted by it, thinking they can do good with it. Through them it only amounts to more government and more spending (read: evil).

What we need are people who can bear the burden of this "ring" and have the strength to take it back to the source and destroy it. That is, destroy the power it bestows.

I have met people in CFL who have said to me "We need to take what the left has done and do it to them!".

Yeah, take the ring off of them, and wear it, and become just as corrupted and evil, serving the same purpose. We see this every 4 or 8 years when they change over from a Democrat sock puppet to a Republican sock puppet, or the other way.

Even Rush Blowhard is saying they (the right) will take all of the democrats' powers and use it against them. The fat bastard fails to realize that the Obama administration is using the power gained for the executive branch by Bush.

I cannot bear the ring, but I will go with the ones who can, to the very fires of Mordor.

If you mean remove all government authority to control the peaceful, honest, voluntary activities of adult individuals, then I totally agree with you.

Once it's "destroyed" and remade, we need a clause for an automatic life sentence with no parole for any government official who is convicted for breaking any law or who violates his or her oath of office in any way. You have to get tough with these politicians or they'll just get corrupted again.

Also, only allow for amendments that expand human liberty - no amendment can ever deprive anyone of any rights. And give the public a referendum veto over all legislation.
