Saying internal party disputes are best left to political parties and not judges, Washoe District Judge Jerry Polaha rejected a lawsuit by a group of disaffected Republicans trying to get to the party's national convention.

The group of about 20 national delegates elected at an insurgent convention of Ron Paul supporters earlier this summer were attempting to halt the Nevada Republican Party from appointing a slate to the national convention during a private conference call scheduled for this afternoon.

But the party's lawyer, David O'Mara, successfully argued that courts do not have the jurisdiction to interfere with a political party's constitutional right to make its own rules and decide its own delegates.

Polaha agreed. He also argued that the breakaway Republicans don't know yet whether they will be included on the party's eventual slate and that the party has mechanisms to resolve disputes.

"They could sit down and say, 'Look what's happening to us,'" Polaha said of the party's scheduled meeting this afternoon. "'We thought the Democrats had problems.'"

Sparks dentist Wayne Terhune, who filed the lawsuit, said he hasn't decided yet whether to appeal.

Well would you look at that. That Constitution thingy is all good as long as it helps the neocons get what they want. But when it comes to us little people, they act like it's value is equal to toilet paper. :(
 
This why we need to stay involved, slowly work our way into leadership positions, and when we know we have the majority, slam the door on them. What goes around, comes around. Keep good notes...we'll need them in four years. Keep your heads up folks. This is no sprint, but a marathon!!

I actually smile when I read these stories, because I know what they have coming, and for me, it's a pretty sight!!
 
What this ultimately boils down to is the GOP can break all their own rules, as often as they like, and can not be held accountable? I'd say their credibility as a "respectable" organization is on the line big time, as if it wasn't already....bastards.
 
Making rules is not the issue. Breaking the rules that were made is the issue and the judge can rule over that.

If the Republican party is breaking state LAW by hand picking a slate... APPEAL THAT SHIT!

At the Minnesota convention they threatened us with the FEC, claiming that we were interfering with a national election by distributing Ron Paul friendly material. Take the NV matter to the FEC.
We've known for years that judges are as worthless as the politicians that appoint them.

The FEC doesn't really represent an improvement, however. If it did, McCain would probably be in Leavenworth now.

Not necessarily. The courts aren't that bad because as has been shown many times, judges don't always rule with their political ideology. Conservative judges don't always rule conservative. Liberals not always liberal. This is how we got two pro-Constitution Supreme Court decisions with the pro-habeas corpus decision and the pro-2nd amendment decision.
 
FFFFF this, get a sympathetic appellate court judge to put in a temporary injunction because of the severity of the matter, at least for the time being, failure to do that will be an absolute shame.
 
I think the decision should be appealled, AND taken to the FEC. The PEOPLE of Nevada, and the country for that matter, need to know the results of this every step of the way. They need to know what the Republican Party is about.

Kinda saw this coming. Judges are on the same team as the defendants. I agree, file an immediate appeal. If the appeals court overturns, its a big blow for the GOP because it can then be cited as case law in other cases. A district judge's ruling means nothing. Appeal it!!

ETA: Does anyone know if it was dismissed with or without prejudice?

Sue the GOP for damages. They wasted the time and money of the delegates....
 
I was afraid this would happen. Actually, there has been no law broken UNTIL the executive committee actually does submit a slate of national delegates. They only said they were going to do it. After they do submit the list, may be a good time to bring up the point of law in court.
 
As much as I want the NVGOP to suffer for there actions, I agree that political parties are PRIVATE organizations, and can do wtf they want.
