I was searching for Cruz's position on the Patriot Act, and this was all I could find.

He supports the Patriot Act in general but understands the widespread concern about it. He is open to examining “reasonable arguments” about the ways the Patriot Act has gone too far.

If Cruz ends up voting in favor of the Patriot Act when it comes up for reauthorization in May 2015, that's really going to create a lot of distance between him and Rand.

He probably supports certain provisions. There is no reason to attack Cruz. He won't win. He's our Gary Johnson except more ambitious
