Arrested & Charged, need advice

Don't forget to file a complaint agaist the cops when all the procedings are over. It will go on their permanate records hurt their ego and their wallet at the same time. ;)
 
Glad to hear this ... But next time DO NOT post your version of what happened on the Internet.

Develop such a thing as a fictitious scenario, and let someone else make the posting.
Such things have happened in the past, and the information has been used against the individual who is charged.

Also,
Put a lawyer on retainer (just in case), keep your mouth shut, and don't be confrontational just to be confrontational.
Your lawyer would have already explained this to you ;)

Yeah, I considered not posting for that reason, but decided with such little time before the hearing that a heap of advice was worth the trade. I don't think you get the right kind of advice from the same lawyer whose income pivots on your decisions ;)

It means that you have given them a small bit of money, and they have committed to represent you, if you need the services of a lawyer.

Shop around in advance, and locate a good one now ... The yellow pages suck !!!

I did this when I started carrying a firearm ... Found someone who specializes in defensive shooting cases.
Gave them some money, and have a 24/7 phone number that I can reach the man with, if needed.

But here is the problem. You knew there was nothing "illegal" going on at the party. The "officer" didn't. Here's where our insane "drinking age" laws come in. The cop didn't want to charge you with anything because you were obviously not doing anything wrong. That's why you were asked to leave, BUT, they wanted you to leave the beer behind, AS EVIDENCE, in case there was "underage consumption" taking place. When you didn't leave immediately, the cop could cite you for "obstruction" because you "delayed" them in "seizing evidence".

When they discovered there were no felonies taking place at the scene, the charges against you were dropped because there really wasn't any actual "crime" taking place, and to prosecute you would be a giant waste of time and money. Plus, you could request a jury trial and I seriously doubt any group of citizens would unanomously find you "guilty".

Unfortunately, the cop was just doing his job because we as a people have lost all sorts of common sense. He probably should have detained you until after the investigation rather than arresting you though.
 
Had the same thing happen years ago in Galveston. Made an appointment with the chief of police and told him what happened. He got the charges dropped and I filed a complaint against the officer.
