Seems like the supervisor knows the law and the field agents do not.

no the supervisor is the PR guy.

All corps run the same way, including the cops. this is how corp america is run. ask a question that shatters the policy and procedure and the morons have no fucking clue what to do. damn the law damn the responsibilities of the office, if it doesn't fit procedure the immediate response is to send the "subject" into escalation mode which includes a quasi arrest detainment that breaks constitutional law.

The only reason ONLY reason the supervisor gets it right is because he is allowed to use an ounce of judgment based on those god damned profiles. I can guarantee if this guy "looked threatening" this incident would have went to the next level, and the next, and next, until every single douchbag up to the president was satisfied that the man in the car was no threat based on some idiot profile.

This guy is an idiot.
He instantly assumes the role of antagonist because he was asked if he was a US citizen?
That is a little extreme if you ask me.
You cannot jump immediately into "Am I free to go" especially after never simply stating that "yes I am an american citizen"

Knowing your rights and being an asshole are not this close together, this guy is just being an asshole.

Everyone seems to be pissed about immigration, but when it comes to checking for illegals the guys trying to enforce the law are screwed with?
Come on...this is not right.
You cannot have it both ways here.
You either have agents looking for illegals or you don't.
It is not unconstitutional to answer a simple fucking question like this and show proof of residency.

It isn't unconstitutional to show or answer anything. It isn't unconstitutional to be asked a question. It is unconstitutional to be forced to show i.d. just because you're walking down the street, or to be detained without probable cause.

Check out Lawson v. Kolender.

I don't want to live in a totalitarian state.

These are not border checkpoints. These are suspicion less checkpoints located 40 miles north of the border on a road that never intersects the border. The officers stop the vehicles and run a dog around the vehicle while they ask "Are you an American Citizen".

Check the 4th amendment. Suspicion less stops are illegal. The officers must have a warrant. The only time that they don't need a warrant is when they have reasonable suspicion that you have committed a crime or that you are in the process of committing a crime. These officers have no suspicion.

He can ask whatever he wants. You do not have to answer. The stop is an illegal seizure. Illegal seizure is the equivalent of kidnapping.

This guy responds just like any patriot should. If you give them an inch they will take a mile. Next you'll have cops going door to door to conduct searches for illegals.

We violate the Fourth Amendment rights of American citizens in the search for illegal immigrants, and then we provide them with food stamps, emergency room services, and mortgages. So, what's our real motivation here?

Officers are nothing more than pawns. They do as they are told from higher ups.

If I feel the need to act like a jackass, I'll ask for the supervisor and tell him off.

Haha this mad me laugh so hard. Am I being detained Am I free to go officer

It isn't funny. It made me cry.

When I was a kid in school, we used to learn about the evils of communism and socialism. Stories about checkpoints and roadblocks were used as teaching instruments as why those things were bad.

They think I forgot what it was like to be able to drive down the street and not need to produce my papers?

I am all for the law of the constitution and all it's rights, but if the border patrol asks a obviously white guy who has no accent if he is an American Citizen, don't you think if he just says, "yes" the border patrol guard will just send him on his way?

I was just trying to put myself in the border guards boots who is just trying to do his job.

The cops & border patrol have way to much power and it does get abused that much is sure.

But people need to be reasonable, the checkpoints are there to stop illegals that's there function, it is an aggravated invasion of our right's for sure. But they are trying to stop a serious problem in the southern states.

So do you think the importance of the inconvenience of a stop should be eliminated, just let the illegals have free reign then. To me it's a bit of a catch 22.

The example's are very much polar opposites, the beating and Tazzering of an American Citizen verses just saying "Yes" to a simple question and then to be sent on your way. It's not the same, not even close

So do you think the importance of the inconvenience of a stop on a sidewalk should be eliminated, just let the criminals have free reign then.

So do you think the importance of the inconvenience of a stop in a mall should be eliminated, just let the possible shoplifters have free reign then.

Where does it stop?

think man!

You really think they have any interest in enforcing the borders against immigrants?

Wake the fuck up.
