Acquitted Militia Members Get 60 Guns Returned

Three members of a Michigan Hutaree militia group are getting back 60 guns between them, including rifles, handguns, shotguns and AK47s, according to the Detroit Free Press.

Thomas Piatek, Tina Stone and Michael Meeks along with six others were arrested in March 2010 as part of an FBI raid because of suspicions of plotting an anti-government revolt. In late March of this year, courts determined that the state was unable to prove its case, so these three and several others were acquitted and set free. Now that they are are out of custody the three are ready to get their weapons back.

Piatek's attorney, Arthur Weiss, explains that Piatek still has a Second Amendment right to own those firearms and the government no longer has any claim to them. US District Judge Victoria Roberts agreed and filed an order that would return the pile of firearms to their owners.

Weiss also argues that there's nothing remotely criminal about owning several dozen guns and close to 100,000 rounds of ammunition. In fact, one of the FBI agents who testified in the case confessed to owning more than 30 weapons.

The hutaree chip-in cube is still up on the libertytreeradio website. Mark's giving all of that to the guys because 2 years 'behind the wire' caused many of them to lose their possessions such as eating utensils, etc since they were unable to continue working behind the wire. See this is how the BAT******S made them pay. They stole their life's time.

Mark Koernke is talking about this case right now on his show. He is saying they are only returning a fraction of what the FED's stole from them and they are under a court order to return everything.

You're right. The US government is not likely to be overthrown by force, since most Americans have no desire to go that way. However, the government is doing a fine job of overthrowing itself. If the US breaks up like the USSR did, I hope we can all get at least one free territory out of it.

Meanwhile, the Second Amendment still allows an individual (or small group) to defend himself (or themselves) or retaliate if need be.

True. The very fact that they didn't use their weapons when the pigs came to arrest them shows that they didn't have any imminent desire to use violence.

I actually LOSE sleep at night because most liberty-lovers, while well-meaning, lack the necessary weaponry, ammo, and equipment to successfully defend their rights. (This is not directed at you personally. It's just a general observation.)

The gear issued to government goons is improving all the time, largely because of the wars in Iraq and Afghanistan. Meanwhile, civilian weapons and ammo are staying the same, at least with respect to effectiveness. Guess who's going to win that race in the end?

-- Armor that protects the entire upper torso against multiple hits of AP .30-06 is old news. I've seen tests showing that a military ESAPI chest plate can even stop a .338 Lapua (albeit only a hollowpoint). Blunt trauma? Sure. But that's a hell of a lot better for your adversary than having a huge hole in his chest, and it will allow him to assault you with much less fear.

-- Polyethylene helmets and face shields have been developed that can stop AK rounds (lead core). Total weight is about 3 lbs for the helmet and a little over 1 lb for the face mask. Thus, if you only have an AK in 7.62x39, you are limited to shooting at arms, legs, and the pelvis (and forget the latter if your adversary is wearing a Level III polyethylene groin protector). I'm pretty sure 5.56 NATO (M855) will still go through this polyethylene armor, at least at close range (tests have shown that M855, with its steel core, does better against polyethylene than 7.62x39 and even .308). But how long will it be before even better armor is developed?

-- Most civilians don't have any night vision or thermal capability. This is understandable, since the good stuff is very expensive. But how many people go on $5000 vacations without a second thought?

Most of the items mentioned above are available for private sale (only the helmet is not). But for how long? And how many people are buying them?

Simply owning firearms is not enough. Also, there is a drastic need for a new movement in civilian gun culture for the exchange of information about home manufacture of accurate armor-piercing rifle rounds. Such manufacture is actually still legal, but even if it's outlawed someday -- well, fuck it, you can't defend freedom if you're always an obedient sheep.

Just a couple of hours work with garden tools can get a decent fighting postion for you. A couple of days can give you overhead cover and be good to go. It is really hard to dislodge a prepared defense with small arms only.
