"We're setting the dogs on your car!" What's the proper response in this case?

If the cops threaten to use the dogs (and you know they'll find something to allow probable cause for a search), do you have to consent to that? Is it constitutional for them to set the dogs on your car without your consent, Constitutionally? What's the proper response if they try to do this?

They gotta get the dogs there quick. There have been cases overturned because people were detained too long while they waited for the dogs to get to the scene.

You are making the mistake of thinking that matters.

Constitutionally,, they should not be stopping you in the first place without sworn statements to a Judge and a valid warrant.

But then again, Constitutionally there should be no such thing as "contraband".

Keep $25k ready for attorneys fees and a digital recorder on hand.

Still after all that you stand better than 90% chance of being convicted if you're caught.

And if "they" find dope in your car you stand a good chance of having your car taken under the civil forfeiture laws.

or... If you are armed, and are holding a badge, simply snuff those b1chez out... Its SOP in some parts, and they will understand.

All you have to remember, is to inform the cops that whatever they're doing, they're doing it without your consent. You do not have to give them your keys. You do not have to answer their questions, but you cannot do anything physically to stop them.

You can let your lawyer handle the rest afterwards.

Never consent.

Never talk to the cops.

Even if they do find something, without consent or your statements, it will be harder to use as evidence against you.

Dummy up and deny every search.

No, I wasn't making any mistake. I know it shouldn't matter, but in today's world, it means everything how you show you can defend yourself from police misconduct and improper procedure. I know it isn't Constitutional for them to detain you in the first place without reasonable suspicion, but I was wondering if dog sniffing actually constituded a "search" despite the claims of the officer that they're "not searching the car" if they let the dogs sniff it.
 
I was once threatened with having dogs brought in. I told them they had 10 minutes to get the dog there as I was in a hurry and if they wished to detain me any longer than that would have to arrest me. This after denying them consent to search. I had hair down to my ass and was driving a conversion van. "What's ah-matter son? Ya got something against the war on drugs?" Told 'em "It ain't about that. It's about my forth amendment rights. That and the fact you are already making me late to my lawyers for a property signing." They called the dog handler and were told it would be at least 30 minutes before the dog could get there. Told them they either needed to let me go or arrest me. They let me go. Results may vary.
 
bottom line, not much you can do to stop them from walking the dog around your car. I had this happen to me once. I refused a search in virginia after being pulled over for "speeding" though i doubt i was since i was going the speed of traffic. They brought a dog out. I did step out of my vehicle making sure to lock all doors;) They ran the dog around my car(nothing) Then they asked me again. I said No. Then i asked if i could go now I am late for work! I then went on my way to work;) Stopped in the parking lot at work. Loaded my bowl puffed;) then walked in to dj a go go bar and jello wrestling! ps while i was sitting in the troopers car. I did give him a packet with legalize marijuana info and talked all about how we need to change the law and will be in the future. I then went into the various reasons why we should legalize marijuana until he gave me my ticket:) hint my lisc plate said Gone-Ja and i had plenty of legalize info on my bumpers. It was the best speeding ticket i ever got:)

Wasn't in Wytheville was it? That's where the dynamic duo motorcycle-cops pulled me. Pulled me saying my passenger, ex-wife, wasn't wearing a safety belt. She pulled the cross strap and gave him her glorious 'duh?' look. Lol. Then he said it was for crossing center line. Ended up just giving me a warning.

if they walk the dog around your car and think they had a hit. They would just get a warrant or try to badger you into consenting into a search inside your car. To me a cop walking around a car with a dog is a search by no consent but by the courts i am sure they would say it is not. what happened to me was like 19 yrs ago.

Yes, but don't keep $25K cash with you in a car. Police would attribute large sums of cash as drug activity and take it in asset forefieture.
