Wisconsin Governor Scott Walker Withdraws Emergency Rule to Implement ObamaCare

06 December 2011

Last month, Wisconsin Governor Scott Walker angered his supporters by signing an emergency rule to implement ObamaCare in the state and keep the federal money that comes with it. Walker’s supporters claimed to feel “betrayed” by the Governor, but Democrats advised Walker to keep the funds and continue to implement ObamaCare, despite the controversy surrounding the constitutionality of the healthcare plan. After the harsh public outcry, however, Walker has withdrawn the emergency rule.

Originally, the Governor sought to implement ObamaCare in his state by way of Assembly Bill 210, but a number of Republican legislators effectively killed the measure by refusing to take any action on it. Walker then introduced an emergency rule that bypassed the state legislature and brought Wisconsin into compliance with ObamaCare.

Background

Supporters Feel Betrayed by Wisconsin Gov. Scott Walker on ObamaCare

19 November 2011 | Activists are fuming after GOP Wisconsin Gov. Scott Walker signed a rule implementing ObamaCare in the state and refused to return federal grant money.

That's only step 1. He still needs to return federal funds for Obamacare:

Because of your continued pressure, Governor Walker has taken the first step in reversing course on implementing ObamaCare in Wisconsin.

But, ObamaCare is still alive and well in Wisconsin.

I am sure you received the email response from Governor Walker stating that he will be reversing course on Emergency Rule 18 that began implementing ObamaCare into Wisconsin state laws. If not, you can read it here.

In the email, Governor Walker repeats the two inaccuracies that I informed you about in the last email.
Inaccuracy #1: Walker did not begin the implementation of ObamaCare in Wisconsin.
Inaccuracy #2: We only had two choices, begin implementation of ObamaCare ourselves or have the feds do it for us.
The good news is tucked away at the very bottom of the email:

"While I remain opposed to the implementation of Obamacare in our state, I do have some concerns regarding the unintended impact the implementation of WI INS 18 Emergency Rule may have on our ability to prevail in overturning this law in the United States Supreme Court. As a result, I have directed the Wisconsin Insurance Commissioner to withdraw WI INS 18 Emergency Rule."

As I said in a previous email, Emergency Rule 18 would hurt Wisconsin in the Supreme Court lawsuit because it would show the court that Wisconsin thinks that the individual mandate IS severable from ObamaCare, exactly what Governor Walker is admitting to now.

While Governor Walker does dance around Emergency Rule 18 beginning to implement ObamaCare, it is obvious your continued pressure has forced him to reverse course on this horrible precedent.

But the Emergency Rule is only part of the problem. Governor Walker must also return the Early Innovator Grant money given to implement ObamaCare exchanges.

In February 2011, Governor Walker accepted an Early Innovator Grant of $37.7 million dollars to help create an information technology network for a system of health exchanges required under national health care reform (ObamaCare).

In fact, the process of implementing the ObamaCare exchanges in Wisconsin has already begun. The website for these exchanges can be found by clicking here.

If these ObamaCare exchanges are fully implemented then it means that everyone who sells health insurance will be fired. It means that all health insurance must be purchased through this ObamaCare exchange website.

All Republican Governors except Governor Walker have refused Early Innovator Grants or have returned them to show their rejection of ObamaCare.

Heritage Foundation on September 28th, 2011 had this to say about accepting and implementing the requirements that come with the Early Innovator Grant: "The combined effect of these regulations and grant requirements are that a state would have to agree to surrender any last vestiges of meaningful control over how ObamaCare is implemented. Thus, a state would now have no more real control over an exchange it set up than over one HHS established."

If Governor Walker truly wants ObamaCare out of Wisconsin as he says he does, then he MUST return the Early Innovator Grant money and halt the implementation of ObamaCare exchanges.

I need you to click here to contact Governor Walker and tell him he must return the ObamaCare Early Innovator Grant money and halt the implementation of ObamaCare exchanges in Wisconsin.

Again, Governor Walker accepted $37.7 million in Federal Early Innovator Grant Funds in February for the specific purpose of establishing a compliant state healthcare exchange which is a key part of ObamaCare. Governor Walker is the only Republican Governor not to have returned these Early Innovator funds.

Keeping these funds will continue to put pressure on the Governor to continue to implement ObamaCare in Wisconsin because that is the only thing the money can be used for.

Please, will you click here to get Governor Walker's contact information, then call him and email him to demand that he return the ObamaCare Early Innovator Grant money just as all other Republican Governors have done?

Governor Walker has made one step in the right direction by stating publicly that he is refusing Emergency Rule 18. Will he show that he is serious in stopping ObamaCare by taking the next step in returning the Early Innovator Grant and halting the implementation of ObamaCare exchanges?

With your continued pressure I have no doubt that he will.

P.S. The Early Innovator Grant is just as dangerous as the Emergency Rule 18 because it continues to put pressure on the Governor to find a different way to implement ObamaCare. Click here to get Governor Walker's contact information and demand that he take the next step in returning these grant funds.
