Van Irion Suing Over Obamacare

Van Irion, Constitutional Attorney and candidate for the 3rd Congressional District of Tennessee will file a constitutional challenge to the “Patient Protection and Affordable Care Act” today at 2pm at the United States District Court in Chattanooga. He will hold a press conference on the steps of the court building.

Irion said he considered taking this action after his trip to Nashville last month to support the Health Care Freedom Act and other bills proposed to protect Tennessean’s against Obamacare. “It became evident to me that the Attorney General was unlikely to take action. Tuesday’s announcement simply confirmed what I suspected.”

Irion says that the AG’s analysis misses the point. “Mr. Cooper bases his conclusion about the constitutionality of the Tennessee state bills on the assumption that the “Patient Protection and Affordable Care Act” is per se constitutional. That is the very issue at stake here. Is the PPACA constitutional or not? If not, then states have every right to defend themselves from its enforcement.”

Irion‘s suit will be challenging the constitutionality of the “Patient Protection and Affordable Care Act” on behalf of one lead citizen of Tennessee. He says that individuals and companies wishing to join the suit as plaintiffs to create a class action against Obamacare can contact him personally at [email protected].
 
I actually like the idea of private citizens like Van Irion challenging the health care bill as opposed to state governments. I like the idea because the state governments are using tax payer money to fund these court challenges when that money could be used to fund our schools, our roads and many other things that our states need right now. I don't understand why the states that are challenging the law just didn't let one state challenge it and use their money and if successful, then file their own lawsuits. Is this more of a political thing to get more votes in the upcoming elections or are these state attorney generals seriously concerned about it's states citizens and their rights?
