So Police Decided to come and sieze my computer in the middle of the night

The past could of weeks we've been having prank call and harassment problems. Recently, the prankster started calling in "bomb threats" or "armed robberies" to my home in 4am in the morning. He did it again tonight, and the police seemed that I was acting suspisious I guess, aos he said he wouldnt to take my computer to check around.

I use my computer a lot, and I don't see how they can do this. Can I get legal action taken again for a wrongful S&S?

Please help.. this is so unfair.

It is illegal to seize property without due process, that means a reason, a judge, and a warrant. Contact the officer's supervisor for return of your property. If you don't get it contact the local Sheriff who is an elected official and ask him to refer it to the district attorney for prosecution.

If by chance you use the computer for work, make the point that they are interfering with your ability to earn a living too.

This I just did. The lady speaking told me to call back tonight where I could reach the Sheriff. They funny thing, I'm listed as the "victom" yes he comes and takes my computer, which is basically my well-being. This is rediculous, and I am hoping to get my computer back.

Record all convos you have with them. (if legal in your state) Let them do the talking. Get a lawyer Tuesday and sue the shit out of them.

Well bascailly they just showed up, said they want to see my computer and take it for "
examinaton" which can take beyond weeks because they look through everyhing on there. Shoult I contact a lawyer about this now? I dont have much money, so not sure where to start.

Yes get a lawyer and get your computer back asap.

OF course they don't have a warrant. I talked to a lady at the non emergency number, she told me to calling back in 12 hours when the Sheriff or dispatched officers are on duty. I wonder if I can do anything else in the mean time.

It will cost hundreds of dollars to "get a lawyer". People need to understand their rights under the Constitution and learn to defend them.

I still believe that the people on here could create a marvelous free university curriculum that people could teach to their fellow citizens.

The assault on our rights is something that happens daily, even the rich can't afford to have a lawyer defending them against this. Knowledge of due process and Constitutional right could be more powerful than guns in reclaiming our birthright as Citizens of the United States.

I still believe There is only one way out the majority of the citizens of this country are going to have to understand what they are about to lose if they don't take action.

Without a lawyer they will continue to break his rights. They dont give two shits about his rights until he gets a lawyer. Sadly, that is how it works in the real word.

If they want their computer back quickly the best way is to get a lawyer. If they do not care if they dont get their computer back in the next two years, they should fight them themselves.

Thats just my two cents from helping fight a corrupt state police for the last few years without the help of a lawyer.

I'm working on a color of law civil rights case against municipal police. I will keep you posted.

For me the choice is give up or go pro se.

I'm not one to give up.

People should be able to enforce their rights under the Constitution without a lawyer. This is a big part of what is wrong with this country.

My boyfriend just recently told me about being able to go to the Sheriff when the police don't do their job. I wish I'd known about that two years ago.

No, Ive enver been arrested before in my life. I've been getting harassing phone calls from some idiot online, and apparently the harrasser used a spoof card to make it seem like I was calling from inside my house. Police came in, asked for my computer, I didn't really know what to do so I just give it to them..

This is outrageous. All attorney's offices are closed Saturday and Sunday, and probably Monday too. Fantastic.

OK - ASAP (TODAY!) contact the Sheriff and the Police - ask to file a written complaint and ask for a copy of the grievance procedures in writing.

Then hire a lawyer if you can't get anywhere and you can afford it.

If you can't start, to contact people in government .

Start with an email to all city admin and city council as they are legally responsible for oversight of the police department. Make it clear in the email that you are alleging violation of Constitutional right to due process.

Go up the chain of command.

You can also sue for return of your property in court without a lawyer.

Have there been other incidents were your rights under the Constitution have been violated?
 
People without prior contact with law enforcement think they are the good guys..

Your first instinct is to trust them.

Then, after the rape, reality sets in.
