Braylen Tootle was hit and carried upside down at Rosa Parks Early Learning Center on just his second day of school.
An Ohio school worker in facing possible prosecution after a video emerged of him striking a 3-year-old nonspeaking boy with autism on Aug. 21 — just his second day at school.
The Dayton Police Department confirmed to PEOPLE on Friday that the case has been presented to the Montgomery County Prosecutor’s Office.
It followed the release of a 17-second clip on Facebook by mom Taneshia Lindsay, which showed an employee at Rosa Parks Early Learning Center chasing her son Braylen Tootle down the school hallway and striking him, which then caused him to fall and hit his head on the floor.
The man then picked her son up by his feet and carried him upside down before walking through the hallway.
“After 3 weeks I finally got the video of my autistic son being assaulted on his 2nd day of school,” Lindsay wrote alongside the video. “Be aware that these are the kind of people Dayton Public Schools hire to work with your 3 and 4 year olds, special needs or not!!”

Lindsay also alleged that the school did not provide “Braylen any medical attention after he clearly hit his head hard asf.”
Braylen’s father, Robert Tootle, told WHIO TV 7 that he heard about the incident when he picked his son up from school and was ushered into the principal’s office. He added that he was then only informed that Braylen had bumped his head and claimed that he did not know the full story until the following Monday when Child Protective Services told him what happened and he watched the video.
