Judge denies lawsuit by breakaway Republicans

Saying internal party disputes are best left to political parties and not judges, Washoe District Judge Jerry Polaha rejected a lawsuit by a group of disaffected Republicans trying to get to the party's national convention.

The group of about 20 national delegates elected at an insurgent convention of Ron Paul supporters earlier this summer were attempting to halt the Nevada Republican Party from appointing a slate to the national convention during a private conference call scheduled for this afternoon.

But the party's lawyer, David O'Mara, successfully argued that courts do not have the jurisdiction to interfere with a political party's constitutional right to make its own rules and decide its own delegates.

Polaha agreed. He also argued that the breakaway Republicans don't know yet whether they will be included on the party's eventual slate and that the party has mechanisms to resolve disputes.

"They could sit down and say, 'Look what's happening to us,'" Polaha said of the party's scheduled meeting this afternoon. "'We thought the Democrats had problems.'"

Sparks dentist Wayne Terhune, who filed the lawsuit, said he hasn't decided yet whether to appeal.
