New Gun Buy/Sell website

I know next to nothing about the laws regarding the sale of guns.

I read the other day that if you go to a gun show, you can buy the gun on the spot and take it home. But, if you go to a range/store, you have to wait until your background check is complete. I am just curious why that is and if your website falls under the rules that a gun show does.

If you buy from a federal firearms license holder (aka FFL or dealer) at a gunshow you still have to have a background check.

The only time you do not need a background check is in a private sale within your state... ie. you pay cash to buy a gun from an individual like your neighbor or someone you meet (like at a gunshow/garage sale/newspaper ad/or online ads)

If you are buying from out of state it has to go through an FFL.

depends on who you buy it from and where.

Private Party transactions i.e. transactions between you and another citizen with a gun: no background check required. must be residents of the same state, otherwise it falls under inter-state commerce and must go through a federally licensed firearm dealer with a federal firearms license (FFL). Gun Shows have dealers that sell guns and those visiting the gun show that sell guns. if you buy from the dealer, they have to do a background check through the FBI. if you buy from another patron, no background check required, though most gun shows do not allow transactions between visitors on their property (you just have to go off site).

Dealers, gun shops, ranges, etc. can only sell firearms if they are a federally licensed dealer, so when you buy from them, they have to do a background check.

internet websites, like gunbroker.com operate like e-bay. But you can't just mail guns; well, you can, but you need to do it with the correct paperwork. and you can't mail the gun directly to someone's house. it all has to go through an dealer/gun shop (FFL). A photo copy of the receiving dealer's FFL is required for mailing a firearm and it can only ship to the dealer. from there, the buyer can then pick it up, but in order to transfer possession of the firearm, the dealer has to perfrom a background check.

If I buy a gun at a local gun show, do I need to register the weapon itself?

I assume you mean from an individual... and that would be no (or at least in tx) it is the same as buying a used washing machine from someone.. give them cash and take it home.

Caution though, as I am only familiar with TX law... it varies state to state, though registration is usally only the big anti gunner states.

being in tx though there is a gun show every weekend somewhere... bring a chair cuz you gonna need to sit down when sticker shock sets in.

unless your new to the game then prices wont seem to bad.
 
I thought I'd bring a grand in cash and see what I can walk away with. I think Pasadena, TX has one this weekend.

$1,000 in cash might get you something, though prices have gone up tremdously in the past 6 months. I don't think you'll be able to get a new AR for that; maybe a cheaper brand like DPMS, Olympic Arms, etc will be close to a grand.

don't overlook the AK and it's variants. there's a reason it's found in every major conflict since 1947. simple and effective under 200yds. with the right modifications, range increases. even with the jump in prices, $1k should get you a nice rifle, plus a case of ammo.

check some of the AR and AK threads in this forum to get some better, more informed opinions. decide first what you want and why, and then you'll be able to figure out what you're looking for and what price you should pay. i'm sure there are some less the upstanding sellers that would easily take $1k from a noob for a SKS with no qualms. be informed and you'll end up fine.

Oh, we're as legit as it gets. We're doing this to keep the 2A alive, and help private owners legally reduce the amount of paperwork and fees they have to pay.

I went to see Dr. Paul speak in the summer of 2007 and had my picture taken with him so I'm not exactly a Johnny-come-lately. I'll continue to post what wisdom I'm able to contribute.

I have always been curious about this.
First let me say that I am NOT looking to buy a gun.
I know people that would give me one but I will not allow it at this time.

But what is a reasonable suspicion?
I don't have "Felon" tattooed on my forehead.
How would some one know ( and should it matter), or how do you ask or check?

Just a silly curiosity to me.
