Man defends himself on subway without anybody dying

Whenever faced with an aggressor, look to first de-escalate the situation. Try to create space if possible, or remove yourself altogether. If that is not possible, then position yourself accordingly to give yourself the best opportunity to protect yourself and to fight back. Lastly, if all signs point towards violence, throw the first punch.

I have given this advice, almost word for word, over the years countless times.

A punch in the face could have led to death just as easily as a chokehold.

Or getting shot, which is what, with my age and ailments, is what I would use.

I'm not getting into a street slugfest.

I think jm's point is that black people are better at doing violence, this guy knocked him out with one punch, no long chokehold needed

I guess black people just have more experience with this sort of thing

Not a chokehold that was kept on 2 minutes after the person being choked was no longer moving. That's a guaranteed kill. There is a reason that UFC refs will quickly stop a fight when it's the person being choked is not responding.

Nope. Notice I didn't say "black man" in the title. There is a right way and a wrong way to do things. Here is a white man Nate Diaz (wel Hispanic I guess but as white a Nick Fuentes) showing the proper way to do a choke in a street fight. Note that he puts the other guy out in seconds and releases the choke.

That's been my point about the Daniel Penny case all along. His actions, while initially justified, were reckless in their execution. He had Jordan Neely under control for 6 minutes before he put the choke on him that killed him for 2 minutes. He could have just kept control until the police got there or he could have choked him for a seconds instead of minutes.

I'm sure there's a debate to be had on the finer intricacies of choke hold execution

But I'll leave that to the MMA professionals

That's why, now in my 60s, I'm not getting into a street slugfest.

There are no refs, there are no mats, there is no "saved by the bell" when fists start to fly and people get choked out.

If Neely had got in my face and said he was going to kill me, he'd likely have gotten shot and he'd be just as dead.

Funny I had a "close encounter of the homeless kind" a few days ago. My dad was in the VA hospital and on my way home at about 9 pm I went to the Cookout (one of my favorite fast food places" to get a quick meal. I saw this white homeless guy in a wheelchair in the parking lot next door who looked pathetic. Both of his legs were swollen like tree trunks. I decided I should get him something so I got a hot dog and some ice water for him. I drove back around and parked and took him the food. His right foot was missing all of its toes and his left leg had an open sore about 6 inches long. He thanked me and said "God bless you." I got in my car and another homeless white guy that I had seen walking around (I didn't think at first he was homeless) came up to me and said something about my door. I'm hard of hearing in one ear now so I didn't quite catch what he was saying. THEN HE PROCEEDED TO OPEN MY DRIVER'S SIDE DOOR! Somebody had backed up right behind me and seem to be just poking so I couldn't just pull out. I was mentally preparing to up kick him in the chest (I was still in my car seat) and yelled at him "What the hell are you doing?" He said some crazy crap about "You're with the government right?" I said "No." He responded "Then why can't you leave?" I said "Because I'm talking to you." He said "Okay" and went on. I'm definitely getting pepper spray.

One more thing. In self defense even something that is justified initially doesn't become justified indefinitely. Take my situation. I think if I had shot the homeless man who opened my door and I convinced a prosecutor or a jury that I was telling the truth I wouldn't have been convicted of anything. But if I pulled a gun and held him at bay for six minutes and THEN shot him, most rational people wouldn't consider that justified. And that's my other issue with the Daniel Penny case. He choked Jordan out after Jordan was no longer a threat. I saw "Nate The Lawyer" bring up a case where a black man stabbed another black man on the subway who had just punched the stabber's girlfriend and tried to use that to justify the Jordan Neely verdict. I generally think Nate does good analysis, but that was stupid in my opinion. Actually PUNCHING someone is worse than walking around yelling "I want to kill people and I'm not afraid to die." And the self defense action that resulted in the fatality happened within seconds of the punch. Also the puncher was MUCH bigger than the stabber. In contrast Daniel Penny was much bigger and more physically capable than Jordan Neely.

I'd be fine with it but that's because I don't like homeless people who harass people

You live in Alabama if I recall correctly.

That is a "constitutional carry" state.

Get a quality carry sidearm AND pepper spray.

That way you have an option between a strong word and a gun.
I can’t support irrational people carrying guns.
