Because it's easier to put pressure on individual members of a state legislature than on a senator. Those state legislators could in turn be pressured to put real pressure on a senator because it's easier to replace them. Think of states who have legislatures have voted to nullify and/or direct their congressional delegations oppose tyrannical legislation such as RealID only to have those congressional delegations ignore the wishes of their state as expressed by the state legislature.

the senate would approve it; he would lose some votes from the McCain types, but would gain Dems on civil rights. plus Fox backs its own.

Dude is too old. He's 63 and overweight. Don't get me wrong, I would LOVE the Judge to be appointed but ideally i'd like a 40 something version of him.
