The so-called 'QAnon Shaman' who pleaded guilty to storming the US Capitol on January 6 has been released from prison to a halfway house 14 months early, in an apparent reduction for good behavior.

Jacob Chansley, 35, pleaded guilty in September 2021 to civil disorder and violent entry to the Capitol, among other charges, and was later sentenced to 41 months in federal prison.

As of Thursday, Bureau of Prison (BOP) records showed, and his former attorney confirmed in a statement to DailyMail.com, that Chansley was in a Phoenix-area halfway house after serving just under 27 months in prison total.

Chansley's release comes weeks after his former attorney demanded he be freed in light of new video from the Capitol riot, but his move to the halfway house appears to be unconnected, a former federal prosecutor who was not part of the case told DailyMail.com.

Though the reason for the transfer is unclear, the former prosecutor said it was doubtful public pressure played a role, noting the move appears 'kind of routine' under BOP guidelines for good-behavior reductions and re-entry programs.

Federal inmates can receive a 15 percent reduction in their prison sentence for good behavior behind bars, and can also serve the final 12 months of their sentences in halfway houses at the discretion of the Bureau of Prisons.

In a statement to DailyMail.com, Albert S. Watkins, the attorney who handled Chansley's plea and sentencing, applauded his transfer to a halfway house.

'After serving eleven months in solitary prior to his sentence being imposed, and only 16 months of his sentence thereafter, it is appropriate this gentle and intelligent young man be permitted to move forward with the next stage of what undoubtedly will be a law abiding and enriching life,' said Watkins.

'I applaud the decision of the US Bureau of Prison in this regard,' added Watkins.

Bureau of Prison records confirmed that Chansley is in the custody of the Residential Reentry Management field office in Phoenix, which contracts with halfway houses to help inmates prepare to reenter society.

Watkins declined to comment on the reason for Chansley's early release, saying: 'This was a decision of the US Bureau of Prisons. I cannot speak for the US Bureau of Prisons.'

In recent weeks, prominent figures including billionaire Elon Musk had called for Chansley's release, citing new footage that appeared to show him being 'escorted' by cops inside the Capitol during the riot.

However, former federal prosecutor Neama Ramani, the president of West Coast Trial Lawyers, told DailyMail.com that it was unlikely the intense scrutiny on Chansley's case had any impact on his early release.

'I don't think it has anything to do with media [or] public pressure,' said Ramani, who is not connected with the case.

He noted that release of inmates to halfway houses for the final 12 months of their sentences was 'kind of routine for the Bureau of Prisons,' particularly for inmates without a lengthy criminal history.

'Despite the violent nature of the Capitol riots, most of the rioters had little to no criminal history,' said Ramani.

Earlier this month, Watkins had argued that Chansley should be freed after Fox News host Tucker Carlson aired previously unseen footage from the riot.

Carlson used his Fox News show to broadcast clips showing Chansley inside the US Capitol.

Chansley appears to be escorted inside the building by Capitol Police officers, while other officers allow the chest-baring, horn-wearing Trump supporter to pass.

On Carlson's broadcast, Chansley's former lawyer said he had not been shown the new footage, which the conservative news anchor said was 'clearly exculpatory'.

Carlson used the footage to argue that the rioters were 'sightseers', and 'mostly peaceful'.

However, other evidence omitted by Carlson shows that Chansley entered the Capitol without permission, was repeatedly asked to leave the building, and was not accompanied by cops at all times.

For instance, a statement signed by signed by Chansley and his attorney contradicts the suggestion that he was 'escorted' by cops throughout the riot.

The statement admits that Chansley entered the Capitol through a broken door as part of a crowd that 'was not lawfully authorized to enter or remain in the building' and that he was one of the first 30 rioters inside.

It also notes that although officers asked Chansley and others multiple times to leave the Capitol, he did not comply and actively urged on his fellow rioters.

The statement describes Chansley's interactions with officers during the breach, but also points out that he 'entered the Gallery of the Senate alone.'

Watkins has previously said that his former client disavows the 'QAnon' conspiracy theory, and prefers to be known simply as 'the Shaman'.

Exactly! Every other person whose reputation and life has been changed should directly have access to any and all footage of themselves. Let the exonerations fly!
 
I'm skeptical of the "this is just routine" explanation.

They came down on the "insurrectionists" with both feet, as hard as they could - and the "QAnon Shaman" in particular was by far the most prominent of such cases. The notion that they have no concern at all for the optics of the matter seems absurd - especially in light of (1) all the hysterical bloviations over the "insurrection", and (2) the recent semi-release of the so-called "J6 tapes" [see this thread].

They may have been worried that Chansley's lawyer's claim that relevant footage from the J6 tapes had been withheld from Chansley's defense might gain some traction, and that it might result in some kind of remedy (despite Chansley's "guilty" plea). By letting him out now, they "save face" (despite their disclaimers that that's not what they are trying to do), and significantly reduce Chansley's motivation to pursue any further remedies (which would bring even more attention and publicity to the matter, and could easily end up making them look even worse - even if Chansley lost any such bid).

So why didn't they show the jury those videos at his trial?

He took a plea. His lawyer said he was never shown this footage which is HIGHLY illegal. It's a Brady violation. He has the right to file a motion to withdraw his plea and have a trial. We'll see if he does that but he might just be happy to be out. To sue for damages under malicious prosecution he'll have to first withdraw his plea.
 
Good, I believe he is guilty but think the sentence was excessive. Bet he is done with Trump now.
 
There are many Antifa protestors that had done more crime than the ones on Jan 6.

That is a true statement. Looting and burning are worse than taking a selfie in the Capitol. Doesn't the Jan 6th defendents didn't commit crimes. I do think most of the sentences were excessive. IMO 30 days in jail would have set them straight.

I was honored to meet Jake Chansley this weekend, and I want to explain why I say honored.

The entire country knows Jake as the face of the Jan 6th “Insurrection” because the media plastered his image and slandered him all over the world, the Biden regime’s DOJ wrongfully prosecuted him for innocently and nonviolently walking through the Capital, and he was then treated horrifically in prisons even being held in solitary confinement for over 10 months just like many other J6’ers.

Yet when I spoke with Jake, he is remarkably positive, happy, forgiving, and determined.

Most people would be crushed and forever destroyed after being treated so horrendously by the media and their own government, but not Jake.

I am constantly angry and frustrated with my own GOP conference that most Republicans in Washington refuse to do anything to help the J6’ers, while the federal government continues to tyrannically destroy their lives.

Many of them nonviolently walked in and out of the Capital and have been and are still being locked up for years, while over 95% of violent BLM and Antifa rioters charges were dropped!

This is such a hypocritical injustice in America and it makes me sick.

If Antifa and BLM walk free after continuous 2020 riots attacking police, federal buildings and monuments, looting and burning, murder, and causing $2+ billion in damages to communities all over America, then J6’ers should easily walk free as well.

There is hardly a comparison and the hypocrisy is grotesque.

Yet it’s not really what J6’ers did that causes the DOJ to continue to persecute them, it’s really about what they said on January 6th.

This is really about punishing Americans who dared to use their 1st amendment - their free speech to protest against the government, which the American people have the right to do, and the DOJ continues to persecute them in order to teach a lesson to the American people to never do it again.

It is cruel and unusual, actually shameful, the way this administration continues it’s perversion of justice.

The American people know it and are grieved and angered by it.

It is literally one of the biggest issues people ask me about all over the country and they always ask me why Republicans don’t stop it.

While Washington DC has one of the highest murder rates and crime statistics in the country, the politicized and weaponized DOJ hunts and persecutes it’s perceived political enemies instead of putting real criminals behind bars and keeping DC safe.

The DOJ thinks and wants you to think that MAGA grandmas and veterans are more dangerous than criminal migrants, terrorists, and child sex traffickers, and Republicans in Washington refuse to work together to stop the politically weaponized DOJ.

Beyond the hat and the face paint is a person, an American, who was wronged by the Democrat mouthpiece media, the Democrat administration, and stuck up weak Republican establishment, and I was honored to meet Jake because he seems to be a better person than all of them combined.

Jake is still the face of January 6th but I think that may be now because he has a spirit of perseverance through times of persecution.

And that’s the spirit many Americans need in these trying times.
