The officer refusing Army orders until Barack Obama documents his eligibility to be president and commander in chief is hitting the airwaves today to answer questions about his challenge to the president.

Lt. Col. Terry Lakin is scheduled to be on the G. Gordon Liddy show tomorrow from 10-11 a.m. EDT.

An attorney for an officer refusing all Army orders until Barack Obama's eligibility to be commander in chief is documented says his client formally has been "flagged" by the military and the formal filing of charges is expected within days.

Attorney Paul Jensen today was on the radio show of G. Gordon Liddy with his client, Lt. Col. Terry Lakin, who has told Obama in a letter that it's up to him to provide the proof.

Officer demanding proof of eligibility accused of failing to report for duty

The U.S. Army has filed two charges against Lt. Col. Terry Lakin, who earlier posted a video inviting that action, over his refusal to follow orders until Barack Obama documents his eligibility to be commander-in-chief.

The documents, filed today and posted on the SafeguardOurConstitution website, which is generating support for the officer, cite alleged violations of the Uniform Code of Military Justice Articles 87 and 92.

Officers can get out of the military quite easily. It's not like enlisted folks who are stuck. His movtive is not to simply just avoid duty. It is probably the most stupid and retarded way to try and do it. There are many options that are less painful and quite legal if that was his goal.

If this guy wants to win his case, he has to be able to prove that Obama's not a natural born citizen. I wonder how he intends to do that, because people have been at that for awhile, and so far nobody has succeeded.

How do you know that?

"It's by far the most difficult thing I've ever done," Lakin said. "The Lord blessed me with a great family, wife and good upbringing. I've tried to uphold the principles espoused by my parents and do the right thing and not take the easy way out. I just seek the truth."

When you join the military you agree to give up your rights and follow orders. If somebody doesn't do that, there are consequences they already agreed to. If somebody thinks they have a legitimate reason for doing that because Obama isn't a natural born citizen, then the burden's on them. The Constitution doesn't say anything about long form birth certificates or whatever else this guy mistakenly thinks is in there.

If you'll pardon my "A Few Good Men" approach ... military can be prosecuted for following orders if the orders are illegal.

Is the prosecution immune from having to prove the orders to be legal?

That said, it seems if the Supreme Court swears in the President, that is the judicial system's acknowledgment of legitimacy.
