"Don't talk to the police"

I can't watch the video right now but people should know that it is legal for the police to lie to you during interrogations. For instance, in an attempt to draw a confession, they can claim to have evidence that doesn't exist and then offer you a "deal" if you just admit to a crime you didn't commit. This is why weaker-willed people are sometimes enticed into giving false confessions.

The best thing to do is immediately make it clear that you won't be answering any questions without an attorney present.
 
I try to instill this into my kids. But the cops are trained to pressure you into talking.

Yep--he's a fast talker all right. He makes excellent points, and I recommend watching the follow-up video where the police officer makes even more excellent points.
 
He's pretty much spot on. But his advice to not talk to cops when innocent is just purely wrong.

If you are innocent, it's best to talk as much as you can. If you don't talk, we quickly assume you are hiding something, and press further.

If you are guilty though, and I can't believe I'm giving this advice, it is best for you to not talk. Of course I'm not advocating you do that, since if you're guilty, why not just come clean.

Worst advice I have ever read.

It doesn't matter if you are innocent or guilty. If you are being questioned in any way by police keep your mouth shut and demand a lawyer. The 5th amendment is there for a reason. Ask if you are under arrest. If you are not under arrest, ask if you are free to go. NEVER talk to the police without your attorney present. They are not there to protect you; they do not care about justice. Their only function is to prosecute you.

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

Talking to the police even if innocent may be considered as witnessing against oneself, especially if the police find a reason to implicate the person for what he said. After all, what is said to the police may be used in a court of law against that person.

Yes, those protections apply to police interrogations as well as the court room. Just remember that if the cops had enough evidence to arrest you, they would. Don't help them get to that point. Ask for an attorney and then ask to leave if you are not under arrest.

Innocent people get sent to jail every day. Don't be a victim.

I have been in such situations. I generally cooperate, as I want to live in a safe community. However, people have been framed. It has happened. It isn't unheard of. At all. And it pays to have a Constitution on your side.

P.S. And nothing ends my cooperation faster than a cop who shows no respect for the Constitution. Nothing.

Only things I will ever say to police: Am I under arrest? Am I free to go? Other than that they get silence, absolute silence. I might even go to sleep.
 
You really should watch the entire video. You may find it educational.

I'm now 6 minutes into the follow-up with Bruch and Amy was right, this guy is really blowing the lid off of the tactics that are used.
