Bentivolio Files Complaint Over Cassis Campaign Plan to Give Voters Bracelets on Primary Day
The 11th Congressional District Republican says the plan violates Michigan Campaign Finance Law.

An Aug. 1 statement by 11th Congressional District Republican primary write-in candidate Nancy Cassis' campaign led opponent Kerry Bentivolio to file a complaint Friday with Michigan's Secretary of State.

According to a release issued by the candidate, the Detroit Free Press reported that Cassis' campaign "is asking supporters to wear special bracelets displaying her name into the polling places. This plan violates MCL 168.744(3), which prohibits the displaying of any material that directly or indirectly makes reference to any election within 100 feet of a polling place."

The Free Press quoted Cassis' campaign as saying they plan to hand out red silicone bracelets bearing Cassis' name on primary day, Aug. 7, "to help supporters get the spelling right."

The Bentivolio campaign release said the candidate is asking the Secretary of State to notify the Cassis campaign about the restrictions in state law. "We have asked the Secretary of State to deny entry to anyone who is displaying campaign materials," the release states.

Write-in candidate's bracelet for voters survives a challenge

When voters get to their local precincts Tuesday, they'll probably get bombarded with candidate brochures, voting lists and pleas for support.

...

Those bracelets, however, violate campaign election law, claim the Michigan Democratic Party and Kerry Bentivolio -- her GOP opponent and the only Republican to appear on the ballot. Both filed complaints with the Michigan Secretary of State and the Wayne and Oakland County clerks to try to stop distribution of the bracelets.

"We want every single Cassis supporter to know that displaying campaign materials within 100 feet of the polling place is illegal," said Bob Dindoffer, Bentivolio's campaign spokesman.

But Fred Woodhams, spokesman for the Secretary of State's Office, said the department sees handing out bracelets as no different than handing out slate cards to voters as they approach polling places.

"As long as the person wearing the bracelet isn't displaying a candidate's name in a polling place, then there is no problem," he said. "A person may keep the bracelet in his or her pocket or handbag, or they may turn the bracelet inside out so the name is on the inside of the link."

No, they absolutely do not. They have no shame. That being said Bentivolio needs to get tough and hit back. Running against the establishment you have to expect these these smear tactics. Remember the level Trey Grayson went to smear Rand?

She will feign ignorance of the law and act like its the first time she ever heard it despite her multiple past runs.

She really be that ignorant. Remember she also was going to use her state campaign warchest to fund her federal campaign until the SOS called her and reminded her it's illegal.

Well, apparently she is getting away with passing out the bracelets.

Did the SOS make a statement that I missed? :( It won't surprise me. She can pass them out, but people won't be allowed to actually display them.

Too bad Bentovolio doesn't have deep pockets. It would be pretty funny to pass out our own bracelets.
