Ironically, this definition actually affirms that there are more than two human biological sexes, despite the document's declared purpose (and despite President Donald J. Trump's spoken intention on this during his 2025 inaugural address), since not all humans ever produce gametes (i.e., either egg cells or sperm cells). So according to this definition, they belong to neither the female nor male sex.
Further, the wording is muddled, since upon conception (i.e., the formation of a zygote), no human produces gametes. And sperm cells only start to be produced during puberty (i.e., for those who do eventually produce sperm cells). So one can read this as meaning that typical males aren't considered to be either male or female until such time during puberty they start producing gametes.
And unless the government is willing to go to genuinely insane levels in order to collect people's potentially-present gametes--such as performing transvaginal oocyte retrieval on phenotypical females' ovaries (since anovulatory cycles occur, so apparent menstruation wouldn't be proof), and testing semen-samples from phenotypical males (since azoospermia occurs, so merely producing semen wouldn't be proof)--then how is anyone to know if they are producing gametes? If a woman has had an obvious pregnancy, then she would know that she produces ova; but even a supposed biological father wouldn't know without a DNA paternity test or sperm test. Short of such demented lengths, the above definition is unenforceable.
Even for those humans who do eventually produce gametes, based upon the above definition specifying the term "reproductive cell", they would have to be viable gametes, i.e., capable of producing a zygote, otherwise they would not actually be reproductive cells. So for those humans who produce infertile gametes, per the above definition, they belong to neither the female nor male sex.
As well, there are many medical disorders of sex development which produce a physiological phenotype in humans that is either opposite of what their chromosomes would suggest, or an ambiguous phenotype (i.e., something in-between female and male anatomy), in addition to there being many sex-chromosome anomalies. For just one example of such conditions, there are people with androgen insensitivity syndrome who are chromosomally XY males, yet they develop in outward appearances as typical females, i.e., with a vagina, breasts, and the usual external feminine features, though they are sterile.
Which is all to point out that God, in Its infinite wisdom, isn't demonically mentally-retarded like many of His/Her/Its falsely-imagined followers: for whom Thinking Is Hard™, so they shan't be having any of that. They wish to keep things simpleton-simple, like their mammy and pappy taught them to do. None of that suspicious thinking-stuff for them! I've heard the theory presented by many that Trump had to roll out the COVID-19 "vaccines" to prevent the deep state from enacting even greater horrors, i.e., with endless lockdowns, FEMA camps, etc. Perhaps so. But Ellison's completely unnecessary presentation hardly goes toward inspiring much confidence. Regardless, it doesn't remove the grim irony of Trump's foregoing post. Basically this protocol involves, as close as practicable, a zero-carbohydrate diet (particularly a diet rich in saturated fats, a variant of which has been termed the carnivore diet); goodly amounts of vitamin D, zinc, vitamin C, and other helpful vitamins and minerals (especially a diet high in salt); and ivermectin and fenbendazole/mebendazole (with hydroxychloroquine possibly being a worthwhile drug to investigate regarding this). So no need for another global round of criminal insanity regarding mRNA "vaccines".

If one were to take President Donald J. Trump's Executive Orders on this seriously, it would also involve transferring people with androgen insensitivity syndrome who are chromosomally XY male, yet who always had a vagina and developed externally as females, into men's prisons. (Although, to be precise, such a person is neither male nor female, per Trump's Executive Order on this: since they do not produce gametes.) And that's just for starters regarding intersex conditions.

As with every major societal problem, I have the objectively-correct solution to this. (That also includes how to safely privatize hydrogen bombs and ICBMs controlled by mutually-reinforcing private-protection agencies using decentralized blockchain technology via smart contracts.)
It involves architecture. House every inmate individually in their own cell, with the cells arranged in a panopticon with a central watch-tower, like slices of pizza with the tower at its center. And you can stack the floors up as high as the highest skyscrapers, if you want, with other structurally-connected panopticon towers giving reinforcement to the others. And since the cells are arranged in pizza-slices, that means that each inmate can have two people to communicate with behind a woven mesh of thick steel wire reinforced by steel pillars and horizontal bars, as is typical in current jail and prison bar-barriers. Have slots between them and a table underneath the slot, with embedded stools for the two prisoners to sit, in order to play board games and trade books, etc.
That would be each individual's "commons" area. Then they would have their personal cells right behind that, with a door they could close for quiet introspection and bedtime, which would also contain their bathroom facilities. One could even have a door behind that for their own small personal outdoor recreation area, with the back-end of that using the same woven mesh of thick steel, which would allow them to see the outdoors and breath fresh air.
And that would be their existence for the duration of their stay in jail/prison.
With my design, it would basically be impossible for one prisoner to hurt another. You could house women and men, children and old, in the same floor-pods and it wouldn't matter, because each would be physically protected by the very design of the architecture itself! And if some prisoner is getting rowdy and making a racket, then house them with the other noise-makers. The same goes with those who are being sexually-obscene in their "commons" area.
But wouldn't that be expensive to house everyone individually like that?
Oh, as expensive as intentionally going out of the way to create mass-loads of killer psychopaths who have a legitimate vengeance upon society?! As expensive as that?
