Winner-take-all CD and AL

Step 1 – Candidate/Delegate Ballot Access

Purpose: To qualify for placement on the primary election ballot.

Timing: 1/2/04: deadline for candidates filing under the “matching funds” method.
1/2/04: filing deadline for individual petitions for CD and AL delegate and alternate delegate candidates.
1/2/04: filing deadline for group petitions for CD and AL delegate and alternate delegate candidates.

Process: Matching Funds Method. A presidential candidate eligible to receive federal primary matching funds may be certified to the primary ballot by filing:

1. The FEC letter establishing the candidate’s eligibility to receive matching funds;
2. The appropriate declarations of candidacy for CD delegates and AL delegates;
3. A list of CD delegates and alternate delegate candidates who will represent the candidate in the congressional districts; and
4. A list of AL delegates and alternate delegate candidates who will represent the candidate statewide.

Each of these documents must be filed with the Elections Division no later than 1/2/04.

No filing fee is required.

Petition Method. This method applies to any candidate who is not eligible to receive federal primary matching funds. Such candidates achieve ballot access through the filing of petitions by delegate and alternate delegate candidates. Delegate and alternate delegate candidates can file such petitions either as individual candidates or as a group of candidates pledged to their first and second choices for president. Each petition paper must be circulated by one qualified Ohio elector. The petition forms are available from the secretary of state.

In addition to the petition and form requirements discussed below, each presidential candidate must file with the secretary of state an order for certificate elections establishing the order of delegate and alternate delegate candidates to serve if the candidate is entitled to any national convention delegates and alternate delegates based upon the
results of the primary election. This filing is required under both the individual and group petition methods.

According to the Elections Division, all of the required forms and petitions must be filed at once, meaning the campaign is permitted “one bite at the apple.”

According to the Elections Division, other presidential candidates have used a “favorite son” candidate (e.g., Ohio elected representative who supports the candidate) as a second choice for presidency. See consent for use of name forms discussed below. This applies to both the individual and group petition methods.

Filing as Individual Candidates. Each CD delegate and alternate delegate candidate must file the following forms with the Board of Elections in the most populous county in the congressional district (see attached list) no later than 4:00 p.m. on 1/2/04.

1. Declaration of candidacy and petitions signed by at least 50, but no more than 150 qualified electors affiliated with the Republican Party (affiliated means an elector who voted in the Republican primaries, or did not vote in either party’s primary elections in 2002 and 2003). Each declaration of candidacy and petition must contain the signatures of qualified electors of only one county;

2. Consent for use of name forms for first and second choice for presidency (must be signed by each candidate);
3. Statement of candidate for election as delegate or alternate to the national convention; and
4. No filing fee is required.

Each AL delegate and alternate delegate candidate must file the following forms with the secretary of state’s Elections Division no later than 4:00 p.m. on 1/2/04:

1. Declaration of candidacy and petitions signed by at least 1,000 but no more than 3,000 qualified electors affiliated with the Republican party (affiliated means an elector who voted in the Republican primaries, or did not vote in either party’s primary elections in 2002 and 2003);
2. Consent for use of name forms for first and second choice or presidency (must be signed by the candidate);
3. Statement of candidate for election as delegate or alternate to national convention;
4. No filing fee is required.

` Group Petitions. If a group of delegate and alternate delegate candidates designate the same presidential candidate, a single petition will suffice for the entire group of candidates. The group petition must designate who is running for delegate and who is running for alternate delegate.

The CD delegate and alternate delegate candidates must be listed on the same petition by CD. AL delegate and alternate delegate candidates must be listed on the same
petition on a statewide basis. The group petitions may be filed only if the group of candidates listed on the petition is equal to the number of delegate or alternate delegates to
be elected on either an AL or CD basis.

Group petitions for groups of CD and AL delegate and alternate delegate candidates must be filed with a properly completed and signed declaration of candidacy with the secretary of state’s Elections Division no later than 4:00 p.m. on 1/2/04.

Each group of CD delegate and alternate delegate candidates must file the following forms:

1. Declaration of candidacy and petitions containing at least 50, but no more than 150, signatures (qualified electors affiliated with the Republican party) (group);
2. Consent for use of name forms for first and second choice for presidency (group);
3. Statement of candidacy; and
4. No filing fee is required.

Each group of AL delegate and alternate candidates must file the following forms:
1. Declaration of candidacy and petitions containing at least 1,000, but no more than 3,000, signatures (qualified electors affiliated with the Republican party) (group);
2. Consent for use of name forms for first and second choice for presidency (group);
3. Statement of candidacy; and
No filing fee is required.

Step 2 – Designation of Campaign Official

Purpose: To notify the state party of the individual who serves as the primary campaign contact.

Timing: On or before 1/2/04.

Process: Each presidential candidate must notify the state party chairman of the name, address and telephone number of the individual who will serve as the campaign’s
primary contact with the state party on all campaign matters. The notification must be made in writing (Permanent Rules, Article X, §2(a)).

Step 3 – Presidential Primary

Purpose: To allocate and bind national convention delegates on a winner-take-all by congressional district basis.

Timing: 3/2/04.

Qualifications: Open primary; no party registration.

Process: Only the names of the presidential candidates appear on the primary ballot.

Step 4 – Organizing State Delegation

Purpose: To organize National Convention delegation and choose delegation leadership and members of the Convention Committees from the state.

: Timing: Promptly following their election (RNC Rule 40(a)).

Process: National Party Rules require the election of one (1) man and one (1) woman for each of the four (4) Convention Committees, including: Committee on Resolutions (Platform), Committee on Credentials, Committee on Rules and Order of Business, and Committee on Permanent Organization. States are required to file notice with the RNC Secretary the selection of these committee members and their state delegation chairman. Alternate delegates may not serve as delegation chairman or as members of the convention committees (RNC Rules, Rule 40(a)).

Step 5 – Certifying Delegates to the RNC

Purpose: Filing of the credentials of the state delegation to the Secretary of the RNC.
Timing: 7/26/04 by 4:00pm – deadline for the designated campaign official
to certify to the Chairman of the Ohio GOP a final list of Delegates
and Alternates.
7/31/04 – deadline for certifying list of Delegates and Alternates to the RNC.

Process: No later than thirty (30) days before the time set for the meeting of the national convention, the credentials of each delegate and alternate delegate shall be filed with the secretary of the Republican National Committee for use by the secretary in making up the temporary roll of the national convention (RNC Rule 18(c)).

After receiving the list of Delegates and Alternates from the Designated Campaign Official, the Chairman of the Ohio Republican Party will convey that information to the
Secretary of State. The Secretary of State will be directed to certify the names of all Delegates and Alternates to the Republican National Convention, in accordance with the Rules of the Republican Party (Permanent Rules, Article X §5).

Presidential Electors

The nomination of candidates for presidential electors shall be accomplished by the Committee at a meeting of the Committee in accordance with the time frames and other provisions set forth in Ohio Revised Code §3513.111.

Other Information

• Presidential candidate names are rotated on the ballot.
• Delegates are “morally” bound to the candidate to whom they are pledged.
• Party rules dictate that a gender balance in the delegation be maintained. Party rules
require gender balance in the national convention delegation (50% male, 50%
female) (2004 Guidelines and Information and Permanent Rules, Article X).

Odd numbered CD’s: 1 woman, 2 men

Even numbered CD’s: 1 man, 2 women
o Alternate Delegates

Odd numbered CD’s: 1 man, 2 women

Even numbered CD’s: 2 men, 1 woman
• The state party chairman can certify no later than 1/2/04 that the names of the
district delegate and alternate candidates must appear on the primary election ballot.
If certified, the electors voting in the primary may be required to vote twice, once for
CD delegate and alternate delegate candidates and again for the AL delegate and
alternate delegate candidates. If no certification, the name of the delegate and
alternate delegate candidates’ first choice for president will be the only name to
appear on the primary ballot.
• Within thirty (30) days (04/01/2004) following the Presidential Preference Primary,
the designated campaign official shall notify the Ohio GOP Chair of the rank
ordering the alternate delegates, with the AL and CD alternates being ranked in
separate groups. CD alternates are ranked only in the CD from which they were
elected (Permanent Rules, Article X, §4).
